At TOBBI, we design and curate products with children’s safety as a core priority. Our products undergo quality control processes and are intended to comply with applicable safety standards for children’s toys and ride‑on equipment. However, even safety‑oriented products may involve inherent risks during assembly, use, and play. By purchasing and using TOBBI products, you acknowledge and agree to this Safety & Liability Policy.

2. User Responsibilities & Safe Use

To help ensure a safe and positive experience with TOBBI products, the buyer, installer, and all users (“User(s)”) MUST:

2.1 Read and Follow All Documentation
• Carefully read and follow the assembly, installation, operating instructions, and safety warnings provided with each product.
• Follow age, weight, and usage recommendations printed on the product and in its user manual. Product details often include guidance on suitable ages and supervision levels.

2.2 Supervision & Environmental Safety
• Always provide proper supervision of children using TOBBI products.
• Ensure play and riding areas are free of obstacles, hazards, traffic, water, slopes, and other environmental risks.
• Do not allow users to use products in a way not intended by the manufacturer.

2.3 Inspection & Maintenance
• Inspect the product before each use for wear, damage, loosening parts, or signs of malfunction.
• Follow maintenance instructions to maintain safe operation throughout the product’s lifecycle.

3. Acknowledgement of Inherent Risk

By purchasing and using any TOBBI product, you acknowledge and agree:

3.1 Risk Awareness
• Products for play and movement (such as ride‑on toys, slides, scooters, and motion toys) involve known and unforeseen risks that may result in injury, emotional distress, paralysis, death, or property damage.
• No equipment, instructional manual, or testing can entirely eliminate all risk of injury. Users may fall, collide, tip over, or otherwise incur harm during use.

3.2 Voluntary Participation
• Use of TOBBI products is at the User’s own choice and voluntary. You assume full responsibility for all risks associated with product use, assembly, storage, maintenance, and transport—even if caused by negligence.

3.3 Supervision of Minors
• Users must ensure children are adequately supervised at all times. Adult supervision is required for products intended for young children (even when age guidance is provided).

4. Liability Release & Waiver

To the fullest extent permitted by law:

4.1 Release of Claims
• You hereby release, waive, and discharge TOBBI, its affiliates, officers, employees, agents, directors, successors, and assigns (collectively, “Released Parties”) from any and all claims, liabilities, damages, costs, or losses arising from or related to your use or misuse of any TOBBI product, including injuries (minor or serious), property damage, or death.

4.2 Indemnification
• You agree to indemnify and hold TOBBI harmless from any and all claims, legal fees, costs, and expenses incurred by TOBBI arising from your failure to comply with this Safety & Liability Policy, including claims made by third parties.

4.3 Legal Costs
• Should TOBBI incur costs or fees (including attorney’s fees) to enforce this Policy, you agree to reimburse TOBBI for all such fees and expenses.

5. Applicability Across Product Life

This Safety & Liability Policy applies to all uses of TOBBI products by you or any User for the lifespan of the product, including second‑hand or gift transfer scenarios.

6. Product Compliance & Safety Information

TOBBI products may be designed to meet applicable safety regulations and standards for children’s toys and ride‑on devices. However, regulatory compliance does not guarantee the elimination of risk. Always ensure products are used as intended and maintain them properly.

7. User Acknowledgement

By purchasing a TOBBI product, you confirm that:

  1. You have read and understood this Safety & Liability Policy.

  2. You agree to abide by all instructions, warnings, and conditions herein.

  3. You voluntarily assume all responsibilities and risks associated with owning and using TOBBI products.
